A dismissal is a single-sided statement from the employer or the employee in order to terminate the existing working relationship. Apart from the dismissal is the appeal, which entails invalidity (void) for the contract of employment from the beginning on. The dismissal is different to the termination agreement, in which the employer as well as the employee agree in the termination of the working relationship.
Laws, regulations and case-law
The regulations for the dismissal are mainly governed by the BGB and KSchG. In addition to this, regulations about dismissal protection have to be regarded in a variety of other laws (e.g. MuSchG, BEEG, PflegeZG, BetrVG).
